How does a taxpayer file to claim a refund for a Texas Franchise Tax Returns?

If an entity made an overpayment of Franchise Tax, this amount does not show on the Texas forms. The Texas Comptroller's Office advises that refund returns should be amended and mailed with an explanation to their office.

If the amended report will result in a refund of taxes previously paid, the claim must comply with Texas Tax Code Section 111.104; the cover letter must state and detail each reason on which the claim is founded.

To amend the Texas return:

  1. Go to States > Texas > screen 1, Reporting Entity (Page down if you are filing several LLC related reports).
  2. Check the Amended Return box (top right-hand corner of this screen).
  3. View and print the return. 
  4. Write, on the top of the Amended report, "Amended Refund."
  5. Sign and mail this Amended return to:
            Texas Comptroller of Public Accounts
            P.O. Box 149348
            Austin, TX 78714-9348
  6. Include a signed supporting statement

Amended Texas returns must be paper-filed.
